B-1. Annual Evaluation of the Superintendent of Schools (Supporting Docs)

 

Receive the School Board Member annual evaluation ratings of the Superintendent of Schools.

 

The School Board and the Superintendent recognize the importance of a formalized process to review the Superintendent's performance. The evaluation process is intended to communicate clear goals and expectations for the Superintendent's performance. The process is conducted, a minimum, twice a year and used for the School Board and Superintendent to acknowledge achievements and provide opportunities for constructive dialogue and feedback. To that end, Section 9 of the Superintendent's Employment Agreement outlines the evaluation procedures. In accordance with the Agreement, the School Board shall evaluate the performance of the Superintendent using the agreed upon form, format and process by September 30th of each year. The 2014-2015 Annual Evaluation of the Superintendent is being submitted to the School Board pursuant to the Agreement. The Agenda Request Form has been reviewed and approved by the Board Chair.

E. OFFICE OF STRATEGY & OPERATIONS

 

E-1. Pre-Qualification of Contractors - Superintendent's Recommendations Regarding Pre-Qualification Certification (Supporting Docs)

 

Approve the recommendation by the Superintendent indicated in the Superintendent Recommendations - Tracking Report.

 

The Pre-Qualification Application process is in accordance with State Requirements for Educational Facilities, F.S. 1013.46, and Board policies 7003 and 7003.1. This item approves recommendations by the Superintendent of Schools as set forth in the Superintendent Recommendations - Tracking Report. Further explanation is provided in the Executive Summary. The Qualification Selection Evaluation Committee (QSEC) convened on August 26, 2015, to review staff's recommendations concerning pre-qualification applications. Upon review of staff's recommendations, QSEC makes the recommendations to the Superintendent indicated in Superintendent Recommendations - Tracking Report.

E-2. Recommendation to Approve Extension of Bid - 11-024T - Emergency Debris Clean Up and Removal Services (Supporting Docs)

 

Approve the extension for the above contract. Contract Term: August 17, 2010, through September 30, 2015, 5 Years; User Departments: Physical Plant Operations; Original Award Amount: $2,000,000; Vendor(s):  Awarded: 7; M/WBE Vendor(s): Landscape Service Professionals, Inc.

 

The request to extend Bid 11-024T for ninety (90) days beyond the expiration date of the current contract period (October 1, 2015, through December 31, 2015) is in accordance with Section 4, Special Conditions 5, Contract Extension.  As of June 18, 2015, the Code of Federal Regulations issued by the Federal Emergency Management Agency was revised to include updated requirements for reimbursement eligibility. Extending this contract will provide the continuity of debris clean-up and removal services if the District were to experience a major hurricane or tropical storm activity, while revising the bid specifications for rebidding.

 

There is no financial impact to the District, as this request is to extend the contract terms for an additional ninety (90) days.

 

E-3. Recommendation to Reject all Bids -16-034T- Emergency Debris Clean Up and Removal Services (Supporting Docs)

 

Approve the recommendation to reject all bids for the above contract. Bid 16-034T was advertised on June 8, 2015. A new bid will be advertised and presented for award at the November 3, 2015, Board meeting.

 

The School Board of Broward County, Florida (SBBC), received four (4) bids for Bid 16-034T, Emergency Debris Clean Up and Removal Services. The bidders were: Bergeron Emergency Services, Inc.; Ceres Environmental Services, Inc.; DRC Emergency Services, LLC; and TFR Enterprises, Inc.

As of June 18, 2015, the Code of Federal Regulations, issued by the Federal Emergency Management Agency, was revised; therefore, all bids will be rejected and the solicitation will be rebid with revised specifications. The District currently utilizes Bid 11-024T for emergency debris clean-up in the event the District experiences a severe storm.

F. OFFICE OF ACADEMICS

 

F-1. Event Agreement between Westfield Broward Mall and The School Board of Broward County, FL for Science Fair Competition and Exhibition (Supporting Docs)

 

Approve Event Agreement with Westfield Broward Mall for use of Broward Mall Facilities for Science Fair Competition and Exhibition. The Agreement period is from February 4, 2016 through February 9, 2016.

 

The Broward County Regional Science and Engineering Fair (BCRSEF) is an annual pre-collegiate science competition that provides a forum to showcase over 800 outstanding student projects from public, charter, and private schools across Broward County. The fair provides an opportunity for Broward students to display their creativity and innovation in a STEM discipline, collaborate with others to understand the scientific and technological changes in society, and to think critically/problem solve for viable solutions to problems in their community, school or national environment while competing for awards and prizes.

 

This agreement has been reviewed and approved as to form and legal content by the Office of the General Counsel.

This Agreement will be executed after School Board approval.

 

There is no financial impact to the District.

 

F-2. Agreement between The School Board of Broward County, Florida and The Broward Partnership for The Homeless, Inc. (Supporting Docs)

 

Approve a new agreement between The School Board of Broward County, Florida and The Broward Partnership for The Homeless, Inc. This agreement shall be for an initial term of three (3) years, commencing on the date it is fully executed by both parties.

 

Career and Technical Education high school and adult postsecondary students district-wide, who are enrolled in Health Science Education Programs, participate in clinical learning experiences through contractual agreements with hospitals, nursing homes, and other healthcare related facilities. The new agreement with The Broward Partnership for The Homeless, Inc. will provide clinical experiences necessary to meet Florida Department of Education mandated student performance standards. This agreement also addresses the requirements of regulatory agencies for students to qualify for certification/licensure examinations upon program completion.

F-3. Agreement between The School Board of Broward County, Florida and Atlantic Shores Hospital, LLC. (Supporting Docs)

 

Approve a continuation agreement between The School Board of Broward County, Florida and Atlantic Shores Hospital, LLC. This agreement shall be for a term of three (3) years, commencing on the date it is fully executed by both parties.

 

The School Board of Broward County, Florida has partnered with Atlantic Shores Hospital, LLC for more than six years. This district wide agreement helps to provide Career and Technical Education high school and adult postsecondary students enrolled in Health Science Education Programs the opportunity to participate in clinical learning experiences, in order to address the requirements of regulatory agencies for students to qualify for certification/licensure examination upon program completion. The continuation agreement with Atlantic Shores Hospital, LLC., provides clinical experiences necessary for students to meet Florida Department of Education mandated student performance standards.

 

This agreement has been reviewed and approved as to form and legal content by the Office of the General Counsel.

The Florida Legislature should boost funding and adopt policies that educate today's students to succeed in tomorrow's world.

To discuss and approve the Greater Florida Consortium of School Boards 2016 Legislative Program.

L-1. Denial of the Charter School Application of Phoenix Academy of Excellence (Supporting Docs)

 

Deny the Charter School Application of Phoenix Academy of Excellence, for the opening of a charter school for the 2016 - 2017 school year based on the grounds specified in the Executive Summary and authorize the Superintendent to issue notice of the denial.

 

Section 1002.33, Florida Statutes, authorizes the submission of applications for a new charter school. Phoenix Academy of Excellence, submitted a formal application to start a public charter school for the 2016-2017 school year.

L-2. Reciprocal Use Agreement between The School Board of Broward County, Florida and the City of Oakland Park (Supporting Docs)

 

Approve the Reciprocal Use Agreement between The School Board of Broward County, Florida and the City of Oakland Park.

 

The current Reciprocal Use Agreement (RUA) between The School Board of Broward County, Florida (SBBC) and the City of Oakland Park was entered into on September 27, 2010. The Agreement is scheduled to expire on September 26, 2015. This RUA contains prior School Board approved solutions to issues (such as the District's implementation of its Four-Day Summer Work Week and the potential resultant increase in facility costs and energy cost) certain municipalities raised a few years ago regarding their utilization of the District's school facilities. The City has indicated its desire to renew the RUA with the SBBC, and has reviewed the RUA.

 

This Agreement has been reviewed and approved as to form and legal content by the Office of the General Counsel, and upon approval by the SBBC, the City will execute the Agreement.

 

There is no financial impact to the School District; therefore this item does not require a collaboration form from the Capital Budget Department.

Policy 3121 formalizes Disclosure Policies and Procedures to comply with the Securities and Exchange Commission (SEC) Rules.

In order to reassign the District's Chief Fire Official designation, a redrafted revision of the Manager, Emergency Management & Chief Fire Official job description was made, resulting in the creation of a new Chief Fire Official job description. Additional revisions were made after the first reading as requested by the Board. The job description was publicized for rule adoption in compliance with Florida Statutes on Saturday, July 25, 2015. School Board Policy 5004.1 establishes school choice (Innovative Programs, Magnet Schools, NOVA, Opportunity Scholarship Program, reassignments, College Academy at Broward College, Broward Virtual Schools, and McKay Scholarship) in the District. Recommendations have been reviewed and approved by the Senior Leadership Team and School Board General Counsel Office.

 

In accordance with School Board Policy 1001, The School Board of Broward County, Florida, has completed the review process for School Board Policy 5004.1. These revisions were discussed at the June 16, 2015 School Board Workshop and at the August 25, 2015 Public Rule Development Workshop.

 

There is no additional financial impact to the School District, therefore, this item does not require a Collaboration Form from the Capital Budget Department.

Adopt School Board Policy 6000.6 Head Start/Early Head Start Major Program Policies and Procedures.

 

Adopt School Board Policy 6000.6 that governs the Head Start/Early Head Start Program. The School Board of Broward County, Florida is the selected Head Start grantee and program's governing body. As such, it is required to make decisions about the program's administration and operations. The responsibilities include the approval of reports, policies, and practices to ensure compliance with the Head Start Program Performance Standards. As per the Head Start Act of 2007, the governing body is required to review and approve the program's policies and procedures.

 

In accordance with School Board Policy 1001, the Head Start/Early Head Start Major Program Policies and Procedures policy was first reviewed at the August 11, 2015 School Board Workshop. The policy was again reviewed at the August 25, 2015 School Board Workshop. This policy was advertised on August 9, 2015.

 

Compliance with this policy will not have an economic impact on The School Board of Broward County, Florida.

The District Policy 6000.1 Committee convened throughout the school year to address issues and formulate proposed changes for the 2015-2016 school year.  A broad representation of district and school-based staff, along with parents and students participated in the committee. Changes and rationales are reflected within the strikethrough version of the policy.

 

These revisions were discussed at the February 24, 2015 School Board Workshop, the June 16, 2015 School Board Workshop, and August 11, 2015 Public Rule Development Workshop for the first reading.

 

This policy was advertised on August 9, 2015.

 

Compliance with the proposed Policy/Rule is not estimated to result in any economic impact upon persons affected by the Policy/Rule. The School Board of Broward County, Florida (SBBC), received seven (7) bids for Bid 16-014R, HVAC-R Parts and Supplies. The purpose of the bid is to purchase HVAC-R Parts and Supplies to replace, repair and maintain air conditioning, heating, refrigeration, and ventilation equipment located throughout the schools and administrative sites in order to provide a comfortable and safe environment. All sites are equipped with an HVAC system designed to maintain proper temperature and humidity levels and schools will also have a refrigeration system to keep food at suitable temperatures. The main items used are:  compressors, refrigerant, oil, oil filters, motors, pumps, sensors, piping and pipe fittings, relays, and switches.

 

The estimated financial impact will be $4,075,000 and is included in the Physical Plant Operations budget. Other funding sources in the District's budget may be used if the project and/or work order is included in a school or department's budget. The financial impact amount represents an estimated contract value; however, the amount authorized will not exceed the estimated award amount.

The School Board of Broward County, Florida, received ten (10) bids for Bid 16-025R, Pumps and Electric Motors. The purpose of the bid is to purchase pumps and motors which are used on our lift stations, boilers, hot water heaters, and specific rainwater projects. Schools with boilers have blower motors and fans along with recirculating pumps to move and heat the water. The Physical Plant Operations department uses motors and pumps for the movement of air and water throughout our equipment. Motors are used to move air on cooling towers, air handlers, air-cooled chillers, exhaust and supply fans, and most types of air conditioning and refrigeration units.

 

The estimated financial impact will be $830,250 and is included in the Physical Plant Operations' budget. Other funding sources in the District's budget may be used if the project and/or work order is included in a school or department's budget. The financial impact amount represents an estimated contract value, however, the amount authorized will not exceed the estimated award amount.

 

EE-4. Recommendation for Additional Spending Authority-52-002R-Facilities Maintenance, Lighting Products, Industrial Supplies, and Tools (Supporting Docs)

 

Approve an additional spending authority for the above contract.  Contract Term:  September 16, 2011, through February 28, 2017, 5Years, 5 Months; User Department: Physical Plant Operations (PPO); New Award Amount:  $4,699,000; Awarded Vendor(s): Fastenal Company; MSC Industrial Supply Company; and W.W. This request is for additional spending authority of $1,324,000.  The Western States Contracting Alliance (WSCA) established a cooperative contract for the purchase of facilities maintenance, lighting products, industrial supplies, and tools. The School Board of Broward County, Florida, approved its usage on September 16, 2011, through February 28, 2014, for $975,000.  The contract was extended through February 28, 2017 by WSCA.  On September 9, 2014, the School Board approved an additional spend amount of $2,400,000.  PPO spent $2,994,376 during the period of the contract.  The estimated spend amount for the past twelve (12) months is approximately $77,800.  There are seventeen (17) months remaining on the contract.  If approved, these funds are sufficient through the expiration of the contract.

Approve Contract #16-CP-CSA-8267-01, Agreement between Broward County and The School Board of Broward County, Florida for Driver and Safety Education originally approved on September 1, 2009.

 

In 2002, the Florida Legislature approved Statute 318.1215, the Dori Slosberg Driver Education Safety Act, which provides additional funding for the driver education programs in public and non-public schools. Legislation provides funding for the direct educational expenses of the driver education program. The funding for this statute comes from fees paid as part of traffic tickets. The original contract (#10-CSAD-8267-01), was approved by SBBC on September 1, 2009. This agreement will begin on October 1, 2015 and continue through September 30, 2017.

 

The provider agreement has been reviewed and approved as to form and legal content by the Office of the General Counsel. Broward County will sign this agreement following the School Board approval.

 

In order to receive approximately $1,200,000 from Broward County, the District allocates $58,358 from the general fund. The District's allocation is included in the department's general fund budget. There is no additional financial impact to the District.

Approve Agreement with Broward Health to provide athletic trainer services to student athletes attending twenty Broward County Public High Schools. The Agreement runs from October 5, 2015 through August 3, 2016. The School Board of Broward County, Florida, on August 4, 2015 extended the Agreement from August 5, 2015 to October 4, 2015 ensuring a continuation of training services for student athletes.

 

The athletic trainer program between Broward Health and The School Board of Broward County, Florida, is consistent with the intent of Florida Statute 1012.46, Athletic Trainers. Pursuant to this provision, the goal of the Legislature is to have school districts employ and have available an athletic trainer in each high school. School districts may establish and implement the athletic injuries prevention and treatment program. Central to this program should be employment and availability of persons trained in the prevention and treatment of physical injuries that may occur during athletic activities.
